alphaAi – Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of alphaAi (“we,” “us,” “our”), including our website, services, software access, and any related products. By using our services, you agree to these Terms.
1.
Services Provided
alphaAi is a SaaS agency providing access to, and customized implementation of, automated messaging software for service-based businesses. Our solution includes AI chatbot setup, integrations, and optional coaching services. The underlying software is provided by a third-party provider (GoHighLevel), and your use of that platform is also governed by HighLevel’s Terms of Service.
2.
User Eligibility
You must be 18 years or older and operate a valid business to use our services. By using our services, you confirm that all information you provide is accurate and that you have the authority to bind the business.
3.
Account Setup & Data Collection
To access our software, you will be required to provide:
Business name, contact information, and social media handles
FAQs, booking links, and other business-specific data
We collect and store information solely for the purpose of delivering and improving our services. You retain ownership of your data. For further detail, please refer to our Privacy Policy.
4.
Privacy & Data Use
We respect your privacy and are committed to protecting your information. We use your data only to:
Set up and manage your chatbot
Deliver customer support
Improve service performance
We do not sell your data. Data may be stored securely on HighLevel’s platform, which follows its own privacy and data protection policies.
5.
Payment Terms
Pricing varies by service level and may include:
Subscription fees (monthly/annual)
One-time setup fees
Optional consulting/coaching charges
All fees are listed in AUD unless otherwise stated and are subject to GST. Payment is due upfront via our secure online system.Initial payment charges to your nominated payment method may be delayed until your service set-up has been completed. Late or failed payments may result in suspension of services.
6.
Free Trials, Discounts & Cancellations
We may offer a free trial at our sole discretion, typically ending after a specific time period (e.g., 1 month) or on a set date (e.g., 1 July). Trials are non-obligatory and can be cancelled at any time.In the event a free trial has been redeemed, the first payment cycle of the nominated subscription will not begin until after the service set-up has been completed and then the free-trial period has elapsed.
We may offer discounts at our sole discretion, typically as a percentage off the full price of a subscription plan. Discounts may be limited to a maximum number of redemptions. If a discount is redeemed but not actually available, we will offer another discount of a differing percentage in good faith.
Additional usage charges (for messages over subscription cap) are not entitled to any discounts. The fees for additional usage are:
alphaAi Basic - 25c per message
alphaAi Pro - 10c per message
alphaAi Ultimate - Nil additional charges due to unlimited messaging
Subscriptions can be cancelled at any time. Upon cancellation, your access will remain active until the end of the current billing period.
7.
Refund Policy
We do not offer refunds for:
Setup or customization services once work has commenced
Partial use of monthly services
Coaching or consulting sessions already delivered
If you believe there’s been a billing error, please contact us at [email protected] within 7 days of the charge.
8.
Third-Party Tools
alphaAi leverages third-party tools and platforms (including GoHighLevel) to deliver our services. We are not responsible for downtime, bugs, or data loss caused by these platforms, though we will assist in resolving issues where possible.
9.
Client Responsibilities
You agree to:
Provide accurate business and FAQ information
Review and approve chatbot responses promptly
Use the service in compliance with local laws and social media platform terms
You may not use alphaAi to send spam, mislead customers, or engage in unlawful conduct.
10.
Service Availability
We aim for 99% uptime but do not guarantee uninterrupted access. Scheduled maintenance and third-party downtime may occur. We will notify you of major outages when possible.
11.
Communication
By using our services, you consent to receive service-related communication via email, SMS, or chat. You may opt out of marketing messages at any time.
12.
Limitation of Liability
To the fullest extent permitted by law, alphaAi is not liable for any indirect, incidental, or consequential damages resulting from your use of our services. Our total liability is limited to the amount paid by you in the preceding 3 months.
13.
Modifications to Terms
We may update these Terms periodically. Continued use after changes constitutes your acceptance. The current version will always be available on our website.
14.
Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of that jurisdiction.
